Filing A Patent

So you think that you have just invented the next hottest product to hit the market and youre wondering what to do next. If you intend on selling your invention and want to be sure that nobody can copy your idea, the answer is simple get a patent. By filing a patent you can protect your invention from being made or sold by others. Filing a patent is not simple, but the following information can offer some guidelines for the aspiring inventor.

Consider A Provisional Patent Application

A provisional patent application can be issued to an inventor if you would like more time to finalize your invention before filing a patent. This gives you a year to fine tune any details, while the date when the provisional application is filed is recorded as the filing date to give the invention an earlier filing date.

Look Into Hiring Professional Help

Having professionals to help you along the process for filing a patent can be the deciding factor in whether or not you obtain a patent. A licensed patent attorney knows the patent process inside and out, whereas the general public does not. They help you sift through USPTO correspondence and help to ensure complete legal protection of your invention.

Perform A Patent Search

Before filing a patent, an inventor should search existing patents for anything that may be similar to or the same as their invention. You can search for patents on your own through the USPTO website or, if hired, a patent attorneys experience allows them to perform a more thorough search. Alternatively, the USPTO will search their database for a fee.

Choose And File A Patent Application

If no similar patents are found, you can move ahead to filing a patent application. A professional can help you decide which application best suits your invention, as there are three types: utility, design, and plant. Each has specific guidelines and filing a patent that is the best fit for your invention makes certain that it receives the fullest patent protection.

Meet The Requests Of The USPTO

Once you have finished filing a patent application, the USPTO reviews the application and may ask you for additional disclosure. They could find the smallest similarity between your invention and an existing one, and they will ask you to distinguish how yours is different. If appealed successfully, the long path to filing a patent could finally come to a rewarding end.
